Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of Branch Forms and related websites or applications operated under this deployment (“Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

To create an account and build forms, you must be able to form a binding contract in your jurisdiction and provide accurate registration information. You are responsible for safeguarding your account credentials and for activity under your account.

3. The Service

Branch Forms allows account holders to create branching forms, publish them when enabled, collect responses from respondents (who typically do not need an account), and optionally connect third-party services such as Google Sheets. Features may change; we do not guarantee uninterrupted or error-free operation.

4. Form owner responsibilities

If you are a form owner, you are solely responsible for the content of your forms, the lawfulness of your data collection, and your communications with respondents—including obtaining any required consents, notices, and rights requests. You must not use the Service to violate law, infringe others’ rights, distribute malware, send spam, or harass users.

5. Acceptable use

You agree not to:

• Probe, scan, or test the vulnerability of the Service without authorization
• Access or use the Service in a way that could damage, disable, or overload it
• Attempt to access data or accounts you are not authorized to use
• Reverse engineer or circumvent security or access controls, except where applicable law forbids this restriction

6. Third-party services

Optional integrations (for example, Google Sheets) are subject to those providers’ terms and privacy policies. We are not responsible for third-party services you choose to enable.

7. Intellectual property

The Service, including its software and branding, is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You retain rights to content you submit; you grant us the rights reasonably necessary to host, process, and display that content to provide the Service.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPERATOR OF THIS DEPLOYMENT AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU HAVE NOT PAID US. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Suspension and termination

We may suspend or terminate access to the Service for conduct that violates these Terms or threatens the security or integrity of the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

11. Governing law

These Terms are governed by the laws of [Jurisdiction / country of the operator], without regard to conflict-of-law rules. Courts in [Venue / courts of competent jurisdiction] shall have exclusive jurisdiction over disputes, except where applicable law requires otherwise.
